By Lane Hatcher Like most people, you probably shop around before you spend your money. And after you buy something, you protect it, right? You keep insurance on your house, get the oil changed regularly on your car, and most important, when you or your family are sick, you get the best healthcare you can. What about your healthcare information? Are you doing everything you can to make sure that your private health information is protected? Do you know what your healthcare privacy rights are? Congress passed the Health Insurance Portability & Accountability Act (HIPAA) in 1996. The HIPAA Privacy Rules, which were created by the Department of Health & Human Services, became effective in April 2003. You now have the rights you need in order to make sure that your healthcare information is safe. If you have any concerns that it isnt, then you can complain to your provider or complain directly to Health & Human Services. Rest assured, should you complain to Health & Human Services, your complaint will be investigated. Since April 2003, more than 15,000 complaints have been received and addressed. So, what are your healthcare privacy rights? First, all healthcare providers such as doctors, dentists, optometrists, etc., are required to give you a copy of their Notice of Privacy Practices. Has yours? Each time you visit a new provider for the first time, their office should give you a copy of their Notice of Privacy Practices. If they dont — insist that they do. The copy of the Notice must be one that you can take with you, or, your providers may arrange to mail it to you. But, they do not get to just show it to you, and then keep it themselves. HIPAA requires the Notice to explain to you, in plain language, what your rights are, what your providers responsibilities are to protect your privacy, and it must tell you how your healthcare information can be used and shared. If the Notice doesnt tell you your rights, insist on getting one that does. Next, you have the right to look at and get a copy of your entire health record that is maintained by each of your providers. Why would you want a copy of your health records? Because unscrupulous employees at doctors offices can — and do — steal health information and use it to steal identities, or sell it to others who will. Example: in 2004, an employee of a cancer center in Seattle stole the identity of a patient, and used the information to spend over $9000 on fake charge cards. That person was sentenced to 16 months in federal prison. Example: just last year, a disgruntled former employee in Providence stole the health information of 200,000 patients. He was caught before he could do any damage, and was recently indicted. There are many more examples of stolen health information. What if your information is stolen from your provider? If this should happen, your provider must notify you so that you can take the necessary steps to protect yourself, such as run a credit report, check for fraudulent use of your credit cards and bank accounts, etc. So, you should request a copy of your health records from all your providers. They are required to give you the copy within 30 days of your request. If your providers cannot give the copy to you within 30 days, they must notify you of their reasons in writing, and then give you a copy within another 30 days. If your providers do not give you a copy of your health records within a total of 60 days, you can complain to them, or you can file a complaint directly with Health & Human Services. You may ask for and receive as many copies of your health records as you like, as often as you like. Your rights do not limit the number of copies you may have. Your providers are allowed to charge you a reasonable, cost-based fee for the copying and postage. Some providers will give you the first copy of your records at no charge, but charge you for additional copies. Other providers will charge you for every copy. What if you get a copy of your health record and notice that something is not correct? You now have the right to ask your healthcare providers to change the information in your health record if you think that it is incomplete or is not accurate. They can refuse your request to change the information, but if they do, they must furnish the reason for the denial to you in writing. If you are given a written denial, then you have the right to submit your reasons for disagreeing with the denial, and your reasons must be added to your health record. Your healthcare providers are allowed to share your health information with other providers. For example, when your primary physician refers you to a specialist, only the appropriate parts of your health record are given to the specialist so that you can be given the best treatment possible. In the same way, your providers are allowed to share your health information with your insurance companies, so they can be reimbursed for your care. Your providers are not required to ask for your authorization in order to share your health information with your other providers or your insurance companies, though it is very common for them to do so. However, there are a number of other situations in which your provider is legally allowed to share your health information — without your authorization. Do you know what they are? For example, all states require your providers to disclose information about certain communicable diseases to your local health department. Your providers may disclose this information without your authorization, but they must also track, or otherwise account for, the disclosure. Other examples include disclosures to law enforcement officials when requested with a court order, court-issued warrant, or subpoena. Your providers may disclose the requested information without your authorization, but again, they must also track or otherwise account to you for the disclosure. There are several other kinds of disclosures your providers must track, and the Notice of Privacy Practices that your providers give to you should tell you specifically what they are. If the Notice doesnt give you this information — then ask that it be provided to you. The most important thing you need to know about the disclosures that can legally be made without your authorization is that your providers must track those disclosures, and they must tell you about them whenever you ask. Remember, your providers do not have to keep track when they share your health information with other providers who are also caring for you, and they do not have to keep track when they share your health information with your insurance company for reimbursement, or payment, reasons. But any other kind of disclosure that is made without your authorization must be tracked, and you have the right to know what those disclosures have been. And dont forget — if your health information is stolen or otherwise disclosed illegally, your providers must notify you. Next, you have the right to restrict with whom your providers may share your health information. But, your providers are not necessarily required to agree to your restrictions. For instance, you can ask that your providers not share your information with certain members of your family. Most providers will agree to this kind of restriction. However, they will not usually agree to a request to restrict disclosures they need to make to other providers for your treatment, nor will they agree to restrict disclosures to your insurance company. And, your providers always have the right to share your health information in case of an emergency. Last, you have the right to ask your healthcare providers to communicate with you through a particular address or phone number. For example, if you dont want them to call you at home with test results, you may ask them to call you at work instead. Or, you may not want to receive test results on a postcard, but instead want them mailed to you in a sealed envelope. As long as your request is reasonable, your providers must communicate with you in the way that you ask. Congress and Health & Human Services have given you some significant rights with respect to your healthcare information. These rights are important tools that you can use to help protect your health and personal information. No one is a better watchdog for your information than you. Know your rights, and use them to make sure your healthcare providers are doing everything required by law to protect you and your precious information. Lane R. Lets face it, whats on offer is not exactly going to be unique is it? So instead of running with the crowd, why not go for something different! Go Green Have fun and be creative. Salvaging and recycling can be so much more than just composting green waste. Think of all the other items that are cast aside in the throes of so many re-vamps and make-overs: brick, stone, redundant furniture, old sinks, cast iron bathtubs, the list goes on. Real Rubbish Garden! At Chelsea a few years ago, the RSPBs Real Rubbish garden designed by Claire Whitehouse demonstrated how reclaimed and re-usable materials could be incorporated in a contemporary garden. Use some imagination Salvaging is all about using your imagination. Rather than throwing out items without a second thought, stop a minute and apply a bit of lateral thinking. Could it be recycled or re-used in other ways? We all make regular visits to our local tip to dispose of rubbish. How often do you stop and look at items others have thrown out? What treasures could you have missed? Plastic coleslaw and salad pots make excellent seed storage containers. Old toilet-roll centres are perfect for starting off broad bean seeds whose deep roots wont be disturbed when it comes to planting them out in their own bio-degradable cells. Old wooden pallets can be turned into the perfect compost bin (who says five into one, wont go!). Even the most unlikely items can be reborn; an old lavatory pan becomes a witty planter; a discarded bath becomes a herb garden. Its not really a new idea either. We all remember the ubiquitous white-washed split tyre planters that appeared everywhere in the seventies but its not so easy to do the whole cut-and-turn thing since the advent of steel belting but a couple of worn-out tyres makes a useful container for any plant thats a bit thuggish and likes to muscle in on its neighbours. I use mine to corral an unruly spread of mint whereas at CAT (The Centre for Alternative Technology at Macynlleth in Wales) they use a tyre stack as a composter. Small but nonetheless efficient. Create something different Its surprising how many old wheelbarrows you will come across on a visit to your local Council Tip A wheelbarrow provides plenty of scope for decorative planting and can usually be picked up for around a fiver. Itll be well-used and showing signs of age, which is perfect for the purpose. If youre feeling really industrious, you could give it a coat of Hammerite to make it look pretty, otherwise just drill or punch some drainage holes, plant up and enjoy. And an added bonus with a wheeled planter is if you fancy a change of scenery, its easy enough to move it around. Need a piece of art to create a focal point? An old push mower or lawn roller takes on a sculptural quality when set against a dry-stone wall and glimpsed through a blossom-clad arch. The same may be said for an old-fashioned horse-drawn ploughshare – make sure you have the space though. Dont overlook old furniture either. You could pick up an old chest for a few pounds and with a lick of paint it can be used to store hands tools, riddles, dibbers and the like and – with a bit of weather-proofing even turned into a tiered display area. When it comes to re-using and recycling we are only limited by our imagination. Discover that elusive bargain Having recently moved home and inherited a garden that beckons contemplation, I decided it was necessary to procure some seating that befitted the task. Disappointed at the sameness of the choices on offer I decided to search for an alternative that I found in the shape of a rather handsome bent-wood rocker. All it needs is some slight attention to a loose splat and a bit of refinishing in order to withstand the elements. Im looking forward to sitting it on the side lawn beneath the boughs of a knarled apple tree and shall inset some bricks (reclaimed of course) in the grass to avoid the rockers becoming entrenched. If you are looking for something with a bit of age and different Auction Houses and Salvage/Reclamation yards are a good place to start you could find Youll only find new ones in shops. There are reclamation and salvage yards, second-hand stores and even auction houses all of which are comparable to the fabled Aladdins cave. Salvage and reclamation is pretty big business these days and it pays to shop around. If you have a project in mind, particularly if you live in a period property, there is no better place to scout around to find authentic and original every-day objects and architectural features to breathe new life into your garden. Keep an eye out for weathered statuary and chimney pots that look terrific planted up or can be used as rhubarb forcers or celery blanchers. Fancy a bog garden? A cast iron bath and Im not suggesting some exotic 400 French jobbie, cheap an cheerful is the order of the day here – sunken into the ground (plug removed of course) is the perfect container. Most towns have an Auction house but be aware that there will be few bargains to be found on Antique or Collectable days. Sometimes you may find Specialist sales with a horticultural or agricultural bent and you may a find a bargain here but broadly speaking, a General Sale is your best bet. General sale days are great fun because the range of goods on offer is so wide, everything from ceramics to furniture and everything in between. Take advantage of the viewing opportunities and dont be afraid to ask the Saleroom Staff how much they think something might fetch and if they think it will be popular. With a bit of homework you may pick up a really bargain. Whether its an old wheelbarrow, planter, pot, chair or statue; reclaimed and recycled items add a touch of individuality and character to a garden and thats something you wont find on the shelves at any out-of-town mall. Whats in your garden? When it comes to recycling in the garden, dont forget the plants themselves. That Rose of Sharon may be the bane of your herbaceous border but to someone else, it represents a brilliant bit of instant ground cover so dig it out, pot it up and pass it on or even sell it at the Car Boot! Recycling is all about sustainability, all about making the very most out of what we have. So get involved. Visit your local tip, look for items to recycle and re-use in the garden. Go round reclamation yards, auction houses and even have another look in your own back yard. At worst, youll save some money and who knows, you may find a hidden gem. The Legal Aid Society’s main function is to provide free legal services to the people living in New York who are living at or below the poverty level. It does this by attracting both water molecules and oil molecules to its own molecular structure. By doing this it bonds the oil and water together and creates a smooth and creamy texture. If you are interested in making your own body lotion, body butter, or body creams then you will need to find an emulsifying wax to act as your base. There are six basic types of emulsifying waxes that hobbyists use when making homemade body lotions. These include: Ceteareth 20, Glyceryl Stearate, Emulsifying Wax NF, Cetearyl Alcohol, Cetearyl Alcohol/Ceteareth 20, and Polysorbate 20. While all of the above ingredients are considered emulsifying wax, not all of these emulsifying waxes are appropriate for every type of lotion or cream. Ceteareth 20 is a common thickener and emulsifier for body lotions and creams. However, it works best when it is combined with another emulsifying wax such as Glyceryl Stearate. The amount of emulsifying wax that you use in your oil and water body lotion or cream will depend on what type of emulsifier you use. For example Emulsifying Wax NF typically makes up between 3 and 6 percent of the total weight of the product being made. Polysorbate 20 is most commonly used for skin moisturizing sprays. When used for in its spray form it is added to the product in a 1 to 1 or 1 to 2 polysorbate 20 to essential oil ratio. Does all hope though come from God? It has been amazing to me the number of coincidences that have taken place in my life that kept hope alive at times when I might otherwise have been ready to give up. For me the answer is clear, God is my hope. Three years ago I began an unusual Christmas project. I wrote a Christmas letter where I shared an answer I had received to one of my own prayers. In that letter I pledged to collect answers to prayers from other people to share in future Christmas letters. I invited the more then 80 families on our greeting card list to e-mail me experiences from their own lives for me to include in my Christmas letter the next year. I didn’t receive a single response. After waiting several months I thought that I should do something. I decided to e-mail ministers all over the world explaining my Christmas project and asking them to share answers to their prayers for me to include in my next Christmas letter. Months went by with no response. I began to think I was not going to be able to continue my Christmas project for lack of material. Just as I was thinking that I’d have to give up my project something happened that kept hope alive. Months after writing to dozens (or hundreds) of ministers one responded with a story that was exactly what I had hoped for. A true life story of a prayer that was answered in a very dramatic way. The minister shared a beautiful story of an unselfish prayer for a despondent father. His story did more than provide the basis for my next Christmas letter it also kept hope alive that I might find more people willing to share their own inspiring stories of hope and faith. Not being internet savy I wasn’t sure how to proceed. Sending dozens of e-mails to receive one response did not seem very efficient. Besides, I really wanted answers to prayers from ordinary people not just ministers. I turned to a good friend who has a small internet business for advice. Creating a web site that would suit my needs turned out to be too expensive. My good friend listened to what I wanted and consulted a site designer who quoted a price of almost $10,000.00. It was so expensive as the site would need to allow people to contribute and add to the site. I could not afford to spend $10,000.00. for my Christmas project. But then technology caught up to my needs just in time. Public bulletin boards hit the internet and could be set up for very little money. Although not ideal it seemed to meet my needs. Within one week of setting up the site I had 100 visitors. More importantly, 3 people shared beautiful stories of how their own prayers have been answered. Hope springs eternal.
